Coinbase is continuing its legal battle with the SEC by seeking access to SEC Chair Gary Gensler’s personal communications. Coinbase argues that Gensler’s private emails are crucial for its defence, especially regarding his views on the regulatory status of digital assets. This request was initially made in April and has been met with resistance from the SEC. Coinbase believes these communications are vital for understanding Gensler’s stance over time, both during and before his tenure as SEC Chair. The SEC, in response, has attempted to block this request, but Coinbase remains persistent, filing another letter on July 3 to push for this discovery, emphasising that Gensler's emails are central to its fair notice defence against the SEC's allegations of operating as an unregistered securities broker​.
