The sentencing phase for Sam Bankman-Fried is underway, with both the U.S. Department of Justice and defence attorneys submitting their arguments to the federal judge overseeing the case. The prosecution seeks a lengthy prison term of at least four decades, while the defence advocates for a shorter sentence, arguing that Bankman-Fried is remorseful and that his life has been significantly impacted by the collapse of FTX. Victim impact statements from former FTX customers have been presented, detailing the financial, emotional, and relational toll of the exchange's downfall in 2022. These statements challenge the defence's assertion that customers would be fully compensated after FTX's bankruptcy, highlighting the lingering impact and loss incurred. The judge will also consider character references from Bankman-Fried's family, colleagues, and friends, as well as his own testimony during the trial. Concerns about potential future fraudulent behaviour, allegations of perjury, and the clarity of the case to the jury will factor into the sentencing decision. The defence has criticised the prosecution's recommendation for its severity, emphasising Bankman-Fried's vulnerability and urging against a sentence that would excessively "disable" him. Bankman-Fried's sentencing is scheduled for March 28.
